A consumer who has concluded a distance contract or a contract concluded outside the business premises of ZM Concept Zbigniew Zygmunt may withdraw from it within 14 days without giving a reason, according to the general principles arising from the regulations concerning distance contracts (in accordance with the Act of May 30, 2014, on Consumer Rights), by submitting a written statement to the seller along with the product and returning the purchased item.
If the consumer chose a delivery method other than the cheapest standard delivery offered by ZM Concept Zbigniew Zygmunt, the seller is not obligated to reimburse the consumer for the additional costs incurred.
The cost of returning the product in case of withdrawal from the contract is borne by the buyer.
The consumer is responsible for any reduction in the value of the product resulting from using it in a way that exceeds what is necessary to ascertain its nature, characteristics, and functioning.
If the consumer exercises the right of withdrawal after submitting a request, they are obliged to pay for services rendered until the withdrawal. The amount to be paid is calculated proportionally to the extent of the service provided, taking into account the price or remuneration agreed upon in the contract. If the price or remuneration is excessive, the basis for calculating this amount is the market value of the service provided.
The right of withdrawal from a contract concluded outside the premises of ZM Concept Zbigniew Zygmunt or at a distance does not apply to contracts:
- for the provision of services, if ZM Concept Zbigniew Zygmunt has fully performed the service with the explicit consent of the consumer, who was informed before the service started that after the service is completed by ZM Concept Zbigniew Zygmunt, the right to withdraw from the contract will be lost;
- where the price or remuneration depends on fluctuations in the financial market which are beyond the control of ZM Concept Zbigniew Zygmunt and which may occur before the deadline for withdrawing from the contract;
- where the subject of the contract is a non-prefabricated item made according to the consumer's specifications or for the purpose of meeting their individualized needs;
- where the subject of the contract is a perishable item or one with a short shelf life;
- where the subject of the contract is a product delivered in a sealed package, which cannot be returned due to health protection or hygiene reasons, if the package has been opened after delivery, as well as personal items that have come into contact with the user's bodily fluids (mouthpieces, spirometers, swabs, etc.);
- where the subject of the contract is goods that, after delivery, due to their nature, become inseparably connected with other items;
- where the consumer has explicitly requested the entrepreneur to come for urgent repair or maintenance; if the entrepreneur additionally provides other services than those requested by the consumer or delivers goods other than spare parts necessary for the repair or maintenance, the consumer has the right to withdraw from the contract regarding additional services or goods;
- where the subject of the contract is sound or visual recordings or computer programs delivered in a sealed package, if the package has been opened after delivery;
- concluded through a public auction;
